Nigerian Jailed 330 Years In The US For Raping his Daughter

This holiday season, Emmanuel Ngene is spending his sixth year inside a South Eastern United States penitentiary. At 56, he has 225 years, five months and ten days left to serve for first degree rape of his daughter, a crime he continues to deny, supported by members of his network of friends and family. Few years after he was incarcerated, Emma Ngene had partial stroke from the stress of the trial and subsequent imprisonment.
Emmanue Ngene, like most aspiring young Nigerians whose lives were mortgaged to a battered inflation-driven economy of early 80s, sought survival overseas. He chose the United States as his destination for better life. He relocated in 1981. He would discover that life in God’s own country was just an imaginary tale. On arrival, Emmanuel desired education. But he had no money. Survival in a strange place, alone, was then important to him. He engaged in menial jobs to support his dreams of a better life here.

Years after he adapted to the lifestyle and surviving the culture shock of a different environment, Emmanuel returned to his hometown in Eastern Nigeria in search of a wife. He found love in Mary, a home girl. They married months after. Emmanuel became a regular visitor to his homeland from America; frequenting his village to be with his new wife and family. He returned every holiday, especially Christmas, to celebrate with his wife and other members of the family. Their first child, a baby girl, was born on November 9, 1998 in Nigeria. The couple would have two additional children after the birth of their daughter.

In June 2007, Emmanuel’s wife and children came to the United States to live in a two-bedroomed apartment with their father. Family and friends said that marital problems manifested when the wife was shocked at the strange standard of living in America as compared to what she was used to in Nigeria. She was also alleged to be disappointed that her husband was a Taxicab driver, an unsteady source of financial income. Emmanuel was gone all day, driving a taxi from morning and returned home at night with not enough income to support the family. Soon, the parents began arguing about money. Mary allegedly complained regularly of being bored at home, caring for the children. Emmanuel, frustrated by her daily musings about life in the United States and insufficient income, encouraged his wife to get certification for CNA: Certified Nurses Aid: she did, passed and got employed at one of the nursing homes as a care giver: providing ageing American population with daily assisted living and care. His wife’s new job, allegedly introduced her to a new social environment. She immediately began to explore her new found friends and friendship within her work place. Emmanuel suspected a change in his wife’s attitudes: she was no longer the charming obedient wife he had in Nigeria. She would refuse his sexual desires and appeals. The marriage became tumultuous.

They were drifting apart as husband and wife: Emmanuel complained to his friends that his wife was always gone and seemed no longer interested in the marriage. It also affected his taxi cab business. He often returned home midday to make sure the children were fed and cared for. Most times, he alleged the wife was gone. When he asked her where she had been, she yelled at him: ‘mind your business. I am a grown woman and I can do whatever I want to do.’ Emma was raging inside. He thought he had a decent beautiful wife that loved the family and the children. He thought it was until death do them part! A wife he married and suffered to bring to America. Their children were drifting apart too.

The circumstances that led Emmanuel Ngene into a lifetime jail are too complex. The stories are bizarre from both sides. Ngene’s family sources, almost seven years after he was found guilty, still believed he was railroaded by his wife and the judiciary. Their stories remain consistent, each alleging that Ngene’s wife, Mary, may have coerced her daughter to lie that her father raped and assaulted her. Part of the family version said that during one of Ngene’s lunch visits home to check on the children, he allegedly found his then young daughter in an explicit compromising position with a neighborhood boy, in the family’s living room!. He became agitated, asked the boy to leave immediately. Soon after the boy left, he grabbed his daughter and spanked her intensely. Mother allegedly walked in as dad was spanking their daughter. She jumped on him and began to scratch and scream. Their daughter, disengaged from the whip, cried profusely from the burns of the belt whipping. She had lacerations on her butt. Their mother, while restraining Emmanuel, instructed their daughter to dial 911. Few minutes later, police came to their door, handcuffed Emmanuel and took him down town. The police officer, noticing the lacerations on the girl’s body, requested for the ambulance to take the young girl and her mother to hospital for medical observations and interrogation. Emmanuel was hauled to jail!

However, in a court document filed, the court posited, “One day in August 2007, defendant asked Cindy(to protect the minor child, the court identified her as Cindy, not her real name) to help him check his email on the computer in his bedroom. After they had finished with the email, defendant told Cindy to stay in the room while he went into the bathroom. He came out wearing only his underwear and a T-shirt. He asked her if she knew what sex was and then pulled down her pants while she was lying on the bed. He pulled off his underwear, got on top of her, and had vaginal intercourse with her. On 31 August 2008, Cindy’s mother took Cindy to the emergency room at Wake Med where they met with a nurse, Kimberly Lewis, and a doctor, Dr. Chris Johnson. Ms. Lewis did a head-to-toe assessment of Cindy and observed bruises on her arms. Cindy told her the bruises came from a broomstick. Cindy also informed Ms. Lewis that she had been sexually assaulted many times.

“Dr. Johnson took a basic history and examined Cindy to determine if she needed immediate treatment. Cindy told him that defendant had been having vaginal and anal intercourse with her over the past year. Because she had not been assaulted within the past 72 hours, Dr. Johnson did not perform a rape kit. Dr. Johnson’s examination of Cindy was limited to her external Instruments and looking for signs of trauma, of which he saw none. He diagnosed Cindy with alleged sexual abuse. He noticed that Cindy appeared somewhat shy and that her mother was “appropriately concerned and worried.”

The hospital notified Wake County Human Services (“WCHS”) and the Raleigh Police Department (“RPD”) of the allegations. Katie Treadway of WCHS and Officer Harvey of RPD arrived at the hospital to interview Cindy. After describing the sexual conduct, Cindy also informed them that one time she bled after defendant had sex with her. She also stated that sometimes defendant “peed on her,” and she had to go in the bathroom to clean herself up. Ms. Treadway felt Cindy was very detailed in her description of the events.

Over the course of Cindy’s fourth grade school year, defendant engaged in vaginal intercourse with Cindy approximately 10 times. Approximately three of these times, defendant had her turn over on her stomach so he could also penetrate her anus. In August 2008, Cindy finally disclosed to her mother what defendant was doing.

At the hospital, the doctors during examination found that she had been penetrated. The police officer asked her who may have penetrated her; she looked at her mother, seeking protection. Her mother instructed her to answer that it was her father! She reluctantly told the officer that her father had penetrated her! The officer asked if she was sure, she bowed and fearfully said yes sir!”

However, Emmanuel Ngene denied the rape charges and penetration of his daughter. He contended that her daughter was sexually molested and penetrated by a boy at her school in Nigeria, the head mistress of the daughter’s school called him when the incident happened and he travelled home to remove his daughter from the school because of the molestation.

The court wrote thus:

“Defendant first contends that the trial court erred in not allowing him to testify regarding his claim that Cindy had been sexually assaulted in 2006 by someone else while in Nigeria. He argues that this evidence was admissible under N.C.R. Evid. 412(b) because it provided an alternative explanation for the paediatrician’s physical findings. Although Rule 412 generally excludes evidence of a complainant’s prior sexual behaviour as irrelevant, it provides an exception for “evidence of specific instances of sexual behaviour offered for the purpose of showing that the act or acts charged were not committed by the defendant.” N.C.R. Evid. 412(b)(2).

“Here, defendant testified during voir dire that, in 2006, he received a call from his wife that Cindy had been sexually assaulted at school, was walking funny, and was bleeding. He claimed that he flew home to Nigeria and transferred Cindy from Graceland Private School, where the assault had supposedly occurred, to another school.

“When Cindy and her mother were questioned on voir dire, however, each denied that any sexual assault had occurred. Cindy acknowledged changing schools, but her mother explained that she had moved Cindy to a different school because Graceland Private School was too expensive.”

Emmanuel remained in the county jail as prosecutors began to build a case against him. The prosecutor offered him a deal: Plead guilty and spend 15 years in jail or go to trial and if found guilty, could face 250 years to life. He refused the deal and sought to be tried because it was an abomination, in his culture, for a man to sexually molest his own daughter and penetrate her. He felt his innocence and said that he would rather die in jail than plead guilty to a crime he did not commit. It took one year for Emmanuel to go to trial. It only took the jury three hours to return with a guilty verdict. Emmanuel was sentenced to 300 to 369 years in prison. On December 3, 2009, Emmanuel Ngene began serving his sentence. He was preparing to travel to Nigeria to bury his mother when he was arrested.

“On 22 September 2008, a grand jury returned 15 separate bills of indictment, charging defendant with four counts of indecent liberties with a child, four counts of Inbreeding, three counts of first degree sexual offence, and four counts of first degree rape. Following trial, the jury found defendant guilty of all 15 counts and also found the existence of an aggravating factor: that defendant had taken “advantage of a position of trust or confidence to commit the offence or offences.” The trial court entered 15 separate judgements. The court sentenced defendant to four consecutive aggravated-range sentences of 300 to 369 months imprisonment for the four counts of first degree rape; three consecutive aggravated-range sentences of 300 to 369 months imprisonment for the three counts of first degree sex offence; four consecutive presumptive-range sentences of 16 to 20 months imprisonment for the four counts of Inbreeding; and four consecutive presumptive-range sentences of 16 to 20 months for the four counts of indecent liberties with a child. Defendant timely appealed to this Court.”

Supreme Court Decides Rev King’s Death Sentence Feb 26

The judgement on the appeal filed by the General Overseer, Christian Praying Assembly (CPA), Rev. Chukwuemeka Ezeugo, a.k.a Reverend King, challenging the judgement of a Lagos High Court sentencing him to death by hanging, was on Thursday, fixed for February 26, 2016, by the Supreme Court sitting in Abuja.
The apex court presided over by Justice Walter Onoghen adjourned for judgment after entertaining arguments from counsel to prosecution and defence in the matter.

Lagos State Attorney-General and Commissioner for Justice, Mr Adeniji Kazeem, who appeared before the Supreme Court alongside the Director of Public Prosecution, Mrs Idowu Alakija and other Senior Counsel in the State, urged the court to dismiss the appeal and uphold the judgment of the lower courts.

Ezeugo was arraigned on September 26, 2006 on a six-count charge of attempted murder and murder
He pleaded not guilty to the allegation but was sentenced to death by the then Justice Joseph Oyewole of Lagos State High Court, Ikeja, on January 11, 2007 for the murder of one of his church members, Ann Uzoh.

Justice Oyewole is now a judge of the Appeal Court sitting in the Calabar division.

The Lagos State Government had said that the convict poured petrol on the deceased and five other persons and that Uzoh died on August 2, 2006; 11 days after the act was perpetrated on her.

Specifically, Ezeugo was convicted and sentenced to 20 years imprisonment for the attempted murder and death by hanging for the offence of murder.

Dissatisfied, Ezeugo challenged the verdict before the Court of Appeal in Lagos, but the appeal was thrown out.

“I hereby rule that the prosecution effectively discharged the burden of proof on it. This appeal is devoid of any basis and accordingly fails.

“The judgment of the High Court is hereby affirmed, and the conviction imposed on the appellant, (which is death by hanging) is also affirmed,” Justice Fatimo Akinbami who read the judgement held.

The two other members of the panel of Justices, Amina Augie and Ibrahim Saulawa concurred with the lead judgement.

Again, Ezeugo not being satisfied with the verdict, approached the Supreme Court, and urged that the judgment be upturned.

Man, 26, defrauds U.S. citizen of $35,000

Operatives of the Interpol section of the Federal Criminal Investigation Department, FCID,
Alagbon Close, Ikoyi, Lagos, western Nigeria, have arrested a 26-year-old man,
Oluwasegun Okuneye for allegedly obtaining the sum of $35,000
from a U.S. citizen, Mrs. Shield Fone under false pretence.
Police alleged that the suspect, a resident of Abesan Estate, Ipaja, Lagos and a
native of Ijebu-Ode area of Ogun State, western Nigeria approached the
complainant on the internet that she has won internet lottery worth millions of
dollars with the conditions that before she could access the money, she will pay a
consultation fee of $35,000 to the management of the lottery firm.
The complainant, according to the police, believed the suspect and pay the
consultation fee of $35,000 into his account No. 446024892324 belonging to a firm,(Core Capital).
Police further alleged that the suspect later approached Alhaji Danjuma Salih
to assist him with an account to transfer the money into his local bank account, but
before they could perfect the transfer of the money, the United States intelligence agency intercepted the money and blocked the transfer.
The complainant later reported the incident to the Nigeria Police and the suspect
was arrested at a hideout in Lagos State.
And after investigation by DSP Abdulahi Jafaru and his team, the suspect was arraigned before an Igbosere Magistrates’ Court, Lagos on a three-count charge of felony to wit, obtaining money from a U.S. citizen under false pretence.
Police prosecutor, Raymond Odion Akhaine said the offences the accused committed are punishable under sections 409, 323 and 404 of the criminal law of Lagos State, 2011.
The accused denied the police allegations in the open court, and Magistrate B.A. Sonuga admitted the defendant to bail in the sum of N1 million with two sureties in like sum.
Sonuga adjourned the case till 14 January, 2016 for mention, while the defendant
was taken to Ikoyi prison, Lagos pending when he will fulfill his bail conditions

Nigerian Man Builds Handmade Excavator (Photo)

Fidellis Nwachukwu, from Imo State, recently displayed his prototype excavator at the Abuja international motor fair. He said he has no formal training in engineering or mechanics and that it was in fact a vision from
God that inspired him to make the excavator. .

He said: “I am truly gifted from God and I have the spirit that enlightens me on what to do. I have a lot to offer my country, my plan is to develop this excavator. We all know that Nigeria is technologically challenged, and we Nigerians and the government are ignorant about this. .

Technologies like this can bring about the improvement of our economy, that’s why I am eager to let Nigerians and the world know that we can develop our own technology. Getting in touch with the government and private investors to support my work was difficult. .

At my first visit to the House of Assembly to get my work viewed, I was accused of being a Boko Haram member and sent away. The government is supposed to see my work, especially the president, the president is like our father and I believe one day I would get the support I need.”

N2.1bn Arms Money Scandal: What I Know About EFCC Probe Of Dokpesi — Mike Ozekhome

Mike Ozekhome, the lawyer to Raymond Dokpesi, founder of Daar Communications, Raymond Dokpesi, has said he was not aware his client received money from the office of the former National Security Adviser, NSA, Sambo Dasuki.

Mr. Ozekhome also said reports that Mr. Dokpesi was arrested by the Economic and Financial Crimes Commission ,EFCC, over the alleged payment, were not correct because Mr. Dokpesi went on his own to the anti-graft agency after receiving a call from its chairman.
“I am not aware the chief collected any money,” he said, referring to Mr. Dokpesi.

A source at the EFCC had told PREMIUM TIMES that Mr. Dokpesi was interrogated by investigators because he received N2.1 billion from the NSA’s office on the eve of the 2015 general election.

The EFCC said it suspected the money was payment for documentaries and advertisements by Daar communications during the electioneering campaign.
“The chief called me earlier in the afternoon to say he received a call from the chairman of the EFCC wanting to see him and I sent one of my lawyers to accompany him. He was not arrested by any group of operatives,” he said.

Mr. Ozekhome said prior to Tuesday’s invitation of Mr. Dokpesi, there was no formal communication from the EFCC to him.
“What I know is that the EFCC wrote to Daar Holdings asking for a list of directors and whether it has done any business or contract with the office of the NSA in the past and how much was involved.

“We wrote them a reply to say Daar did not do any contract with the office of the NSA and we are ready to give them all the information they need,” he said.
The EFCC has arrested a number of individuals indicted by a presidential investigations committee into arms procurement by the Goodluck Jonathan administration.

The committee had in its interim report said that it found extra-budgetary spending by the Jonathan administration to the tune of N643.8 billion and an additional $2.2 billion in foreign currency component.

A competent source at the EFCC had earlier told us that Mr. Dasuki had received N2.1 billion from the money.
“Chief Dokpesi received N2.1 billion from the NSA’s office but investigators cannot see any clear reason for the payment,” he said.
The source said investigators were “suspicious that the money was passed to him as payment for the damaging documentaries and campaigns his station ran on Buhari, Tinubu and Amaechi”.

President Muhammad Buhari, Ahmed Tinubu and Chibuike Amaechi are leaders of the ruling All Progressives Congress.
At the time the money was allegedly paid, Mr. Buhari was the party’s presidential candidate.
“They believe the funds were budgeted for arms procurement but was diverted to Mr. Dokpesi,” the source said.

Agony, hardship as power supply drops to six hours daily

The sufferings and hardship currently witnessed by Nigerians across the country took a turn for the worse in Abuja in the last couple of days as Abuja Electricity Distribution Company reduced power supply to the Federal Capital Territory and neighbouring states to an average of six hours.

This was in negation of recent claims by the Transmission Company of Nigeria, TCN, two weeks ago, that power supply had hit a new high of 4,488 megawatts (MW).
Vanguard observed that over a month, the power situation in Abuja took a turn for the worse, with households having to grapple with exorbitant electricity bills despite the absence of electricity.

However, only a few high-brow areas and selected areas like Asokoro, Maitama, Wuse 2, Gwarimpa, among others and some areas with lesser population, like Dutse-Sokale,
Dutse-Alhaji; some selected streets in Arab Road and Fate Foundation in Kubwa, all in Bwari Area Council, can boast of a near stable supply of electricity.

In a chat with Vanguard on the epileptic power situation in Abuja, the spokesperson for the AEDC, Mr. Oyebode Fadipe, blamed the drop in power supply to a decline in power generation and some challenges experienced in the area of transmission.
He stated that Nigerians should not expect a drastic improvement in power supply at the moment, as 24 months is still not enough time to do the radical change that people desire to see in the power sector.

Fadipe disclosed that AEDC has spent over N2 billion for the rehabilitation of legacy projects, while it is currently spending N1 billion for ongoing projects, adding that all these is to enable it bring the network to the point of significant improvement.
He said, “It is because of these investments that we are even talking about the electricity we have today, otherwise, 24 months ago it was really drastic.
Shortly before the election in May it was a very bad situation; where even as a company we got only 18 megawatts Then how do you share such megawatts, we do not have licence to generate, we only have licence to distribute.

He, however, blamed the low power supply in some areas on the fact that some of the areas are highly populated and are high consumers of electricity.
He said, “The second side of it is that there may be local problem and coincidentally you find out that areas such as Kubwa, Karu, Nyanya, Lugbe among others, are high density areas. Kubwa is the largest satellite town in Abuja, and then you have Karu, Nyanya and isolated cases like the case of Garki.

“The issue is not even about population, the basic issue is availability, it will either be at the point of available generation or there is equipment inadequacy.”
Despite the assurances by, residents in Apo Village told Vanguard that they have not had electricity for about two months due to a faulty transformer.

One of the residents, Kokoma Gabriel, said that efforts to get AEDC to fix the transformer had been unsuccessful, as some staff and agents of the company have requested for financial motivation before the transformer would be fixed.

In Kubwa, residents staying near the village market claim they hardly get electricity for about four hours daily, while residents in Phases Two, Three and Four, PW and environs claim they only get electricity for about six hours, mainly at night.

In Lagos Street, some area of Gado Nasko, 2-1 Market and environ, ‘loss of phase’ has become a permanent feature as some lines goes off for the few hours power supply is restored.

One of the residents, Mr. Chisom Umeh stated that several attempt to get officials of AEDC to fix the problem permanently had not been successful, as the problem always resurfaced, sometimes, one hour after it is rectified.

Also, Kubwa is littered with abandoned power projects as a World Bank assisted programme to supply small-size transformers to residents in the area appeared to have been abandoned for almost two years since the project commenced.

In the twilight of the Goodluck Jonathan’s administration, polls that were meant to bear the transformers were quickly installed by some contractors who told Vanguard that the programme was a World Bank project. About a year after, the poles are still standing while no transformer had been installed.

Residents in some areas in Nyanya, Karu, Jikwoyi, Mararaba, Kuje also lamented the epileptic power situation and ineffectiveness of AEDC, stating that they scarcely get electricity for an average of six hours daily.
Area 7 and Area 8 in Garki, in the Central Area was not left out, as many organisations around the area had to resort to the use of generating sets to power their business premises.

Also, some areas are condemned to rationing or load –shedding, as they see electricity on some days while on some other days they stay in darkness.
Specifically, one resident in Lugbe, Mr. Samuel Abass, said power supply to their area is on a “One day on, one day off,” basis.
He called on the Federal Government to come to their aid and save them from the ineffectiveness and exploitative tendencies of the power companies.
